Equal Opportunity Laws and Regulations
Age Discrimination Act of 1975
- Prohibits discrimination based on age in programs/activities that receive federal funding.
Age Discrimination in Employment Act (ADEA) of 1967
- Prohibits discrimination in employment based on age against applicants or employees who are 40 years of age or older.
Equal Pay Act of 1963
- Prohibits discrimination in the payment of wages or benefits on the basis of sex where men and women perform equal work of similar skill.
Executive Order 11246
- Prohibits job discrimination based on race, color, religion, sex, or national origin and requires affirmative action to ensure equality of opportunity in all aspects of employment by Federal Contractors and Subcontractors.
Executive Order 11246 - Pay Transparency Nondiscrimination provision
- Prohibits discrimination based on inquiring about, disclosing, or discussing their own compensation or the compensation of other employee or applicant.
Executive Order 13672
- Prohibits discrimination based on sexual orientation and gender identity by Federal Contractors and Subcontractors.
Immigration Reform and Control Act (IRCA) of 1986
- Prohibits discrimination in employment-related matters on the basis of national origin or citizenship.
Pregnancy Discrimination Act of 1978
- Prohibits discrimination on the basis of pregnancy-related medical conditions and mandates that pregnancy is treated the same as other temporary disabilities.
Section 503 of the Rehabilitation Act of 1973
- Requires covered federal government contractors and subcontractors to take affirmative action to employ and advance in employment qualified individuals with disabilities. Invitation for self-identification at pre-offer and post-offer phases of the application process.
Section 504 of the Rehabilitation Act of 1973
- Prohibits discrimination based on disability in programs/activities that receive federal funding.
Texas Commission on Human Rights Act – Chapter 21 of the Texas Labor Code
- Prohibits employment discrimination in all employment decisions based on a person’s race, color, disability, religion, sex, national origin, and age. Enforced by Texas Workforce Commission, Civil Rights Division.
The Americans with Disabilities Act (ADA) of 1990 and ADA Amendment Act (ADAAA) of 2008
- Prohibits discrimination in employment based on mental or physical disability. Requires employers to make reasonable workplace accommodations for qualifying individuals.
The Genetic Information Nondiscrimination Act (GINA) of 2008
- Prohibits discrimination against employees or applicants due to genetic information.
Title VI of the Civil Rights Act of 1964
- Prohibits discrimination based on race, color, and national origin in programs/activities that receive federal funding. Inquiries regarding Title VI should be referred to the Equal Opportunity Office at eoaa@utep.edu.
Title VII of the Civil Rights Act of 1964, as amended
- Prohibits discrimination in employment based on race, color, national origin, sex, or religion.
Title IX of the Education Amendments of 1972
- Prohibits discrimination based on sex in education programs/activities that receive federal funding. Applies to employment and/or admission to such programs and activities. Inquiries regarding Title IX should be referred to UTEP’s Title IX Coordinator in the Equal Opportunity Office at eoaa@utep.edu.
Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA) of 1974
- Requires covered federal government contractors and subcontractors to take affirmative action to employ and advance in employment specified categories of veterans protected by the Act and prohibits discrimination against such veterans.
